Abstract

The author considers it urgent to reform the legal provisions regarding the withdrawal and reissue of the permission to drive. In his opinion the parallel approach which was introduced over 20 years ago and whereby the withdrawal could be made partially by the Court and partially by administrative measures, has not proved itself. He supports the introduction of the exclusive responsibility of administrative authorities, leaving to the courts only the right to prohibit driving or the tentative withdrawal of the permission to drive. In this context he is also opposed to retain the schematic arrangement in terms of par.69, section 2, subsection 2 in the Law Book, which requires that, in an offence of 'drunk in traffic', a suitability deficiency must be accepted in principle. Preference is given to an individual testing of each single case supported by medical-psychological assessment.
