Abstract

According to the Austrian Road Traffic Law (StVO) a driver stopped by the authorities has to undergo a breath alcohol analysis. In cases of negative testing for alcohol or a suspected influence of drags the driver has to undergo a further medical examination. Even if there is cause to suspect the influence of drugs blood sampling against the drivers will is not permitted. However, the refusal of blood sampling is liable to punishment. The current regulations and weaknesses are presented. In cases of drug related offences in road traffic only the quantitative examination of a blood sample is able to meet the requirements for legal security.
