Abstract

On the background of a recently published decision of the OLG Saarbrucken the article deals with the topic of driving inability due to drug-induced impaired vision. The author comes to the conclusion that a limitation of the pupil's adaptation ability due to the consumption of narcotics and the thus caused significantly higher sensitivity to dazzling leads to a driving inability according to (section) 316 StGB (German Criminal Law statute). The existing further limiting jurisdiction has to be estimated as overly restrictive.
