Abstract

The author opposes the absolute reliance on blood alcohol levels when determining fitness to drive under the influence of alcohol (a maximum blood alcohol of 0.13%). This implies that at any time there must be a certain alcohol concentration before a flooding effect is produced in the driver by the alcohol. The author objects to jurisdiction based upon research results in the natural sciences. The author suggests new legislation to bring about standardization and to bring the law into accordance with scientific facts.
