Abstract

The author critically reviews the legal possibilities of after-schooling in terms of article 69 section 7 of the relevant legislation. He agrees with the present verdict that in principle the possibility of after-schooling may be considered, but is of the opinion that the mere participation is not adequate. He therefore demands individual assessment by the course leader. The author bases his opinion on the fact that in the course, the criminal and sociological aspects of drunken driving are not sufficiently stressed, that adequate guidelines for future behavior cannot be given and that the persons required to attend the course are not meticulously selected. He emphasises that the present application of the system restricts the judicial function of the presiding officer in favor of social scientific investigation, which is of secondary importance.
