Abstract

On the basis of verdicts in terms of the 0.8(per mille) Act (section 24a of the Traffic Act) the author discusses points of special importance relevant to alcohol in road traffic: the definition of motor vehicle is given (vehicles propelled by an engine, not restricted to rails, irrespective of their use, with prescribed maximum speed and the requirement of a licence to drive). The factual evidence of 0.8(per mille) is determined from several single values with no modification of the average or other amendments. It is not considered important whether the 0.8(per mille) level occurred during driving or thereafter.
