Abstract

The author evaluates the demand, which appeared during the last few years in the literature, to amend the withdrawal of permission to drive as a secondary sentence. He investigates the question of the influence of present sanctions on traffic safety and concludes that the withdrawal of the driving licence is an important measure in changing the attitude of the drunk offender. Furthermore, the author sketches the post-schooling models for alcoholic drivers as applied in the Federal Republic of Germany, with special reference to first offenders. He is of the opinion that post-schooling should be implemented but principally only after the judicial proceedings. The author finally describes how the latter can be implemented uniformly throughout the Federal Republic and the required legislative procedure for this purpose.
