Abstract

This Spanish Instruction sets forth guidelines for dealing with maltreatment of minors and women. It provides that prosecutors are to set an example in curbing the physical harm and maltreatment of children; to take decisive action in protecting minors who are maltreated or abandoned, in conformity with Civil Code provisions on adoption; and to make an annual inventory of all legal actions relating to maltreatment and physical harm of children. It also provides that prosecutors should prosecute with all determination cases involving physical harm to and maltreatment of women, setting an example in curbing such activities. Through their investigations, they should supply proof that may be lacking and they should make an annual inventory of all legal actions in this area. The Instruction also tells prosecutors to put all their force behind ensuring that support obligations to children and former spouses are complied with, and to institute criminal proceedings when necessary.
