The Omnibus Employees Testing Act of 1991 (part of the Department of Transportation and Related Agencies Act of 1992) mandated rules and regulations on drug and alcohol testing for employees in &quot;safety sensitive&quot; positions. 2. Employees in &quot;safety sensitive&quot; positions who misuse alcohol jeopardize themselves and others. As a noninvasive, relatively quick method for testing alcohol misuse. Evidential Breath Testing allows an employer to test, and if the results are positive, to immediately remove an employee from a &quot;safety sensitive&quot; position. 3.
