abstract="The present article gives attention –- based on the assumption that legal high substances may cause serious health damages -– to the issue, whether and under which circumstances the commerce with legal high products is punishable according to the current law. the main focus is aimed at the description of the legal controversy, whether the legal term “medicinal product by function” (§ 2 abs. 1 nr. 2 lit. a aMG) covers legal high substances or if it doesn't, since legal high substances do not serve therapeutic purposes.  The author arrives at the conclusion that the current criminal law is insufficient and that the legislative authority –- as long as it maintains the system of listing individual substances -– will chase a fast reacting “market” in vain.",
