abstract="The article explains the verdict passed by the county court in Cottbus. The court ruled a driving instructor under the influence of alcohol guilty of a punishable offence, despite the fact that he himself did not drive the car, nor could it be proven that he used the dual control pedals. In the light of this, the above article criticises the fact that the county court in Cottbus misjudged the nature of the offence for a so called &quot;personal&quot; offence. The legal character of a &quot;driver behind the driver&quot; cannot exist - especially not within the framework of the (section) 316 StGB -hence the driving instructor ought to have been cleared of all charges.<p />",
