abstract="The loss of driving licence due to driving under the influence of alcohol outside working hours constitutes an 'important reason' in terms of paragraph 626 Section I of the Act for the employer of a professional driver. In the compulsory testimonial which the employer must issue (in terms of paragraph 630 of the Act), he may not withhold the reason for dismissal (cancellation of driving licence) as this may be considered to be an offence committed against a potential 'new' employer. Should the employee not be satisfied with a reference to the charge of driving under the influence of alcohol in his testimonial, he may institute a so-called correction procedure. The employer is well advised if he, with the support of the directors, issues a total alcohol abstinence during working hours and threatens the professional driver with an unconditional dismissal if found guilty of driving under the influence when driving privately.<p />",
