abstract="In the present paper we address the issue of the intimate partner violence from scientific research data. Two basic kinds of violence are described: coercive violence and situational violence (associated with managing everyday problems or with how to manage breakup). From this distinction, strategies for differential diagnosis in the context of Spanish forensic psychological assessment according to Organic Law 1/2004 are proposed. Expert psychologist's appropriate intervention in this field would help to adjust the judicial measure to the current needs of the family, and would avoid excessive intervention of Criminal Law in issues and conflicts that are more suitable for Family Courts.
