abstract="The Author, a psychiatrist, works in the Italian public welfare system regulated by non-coherent norms, a system of community and without custodial structures. Since the care warrant is fragile, improper requests may lead psychiatry to ineffectiveness derelict drift or an impossible neocustodial task. We need a cultured, scientific psychiatry, that is aware of its limitations. Psychiatric evaluations based on neo-positivist models have been the basis of psychiatrists' convictions for suicide or homicides committed by patients. A renewed alliance with legal medicine and the world of justice must focus on the person in the community: this is the only way to develop an interinstitutional collaboration, as indicated by the Superior Council of Magistracy. The issue of the responsibility of the psychiatrist, must be rethought, recognizing the extreme difficulty of the task the &quot;therapeutic privilege&quot; and forms of institutional responsibilities. © Pensa MultiMedia Editore.<p /><p>Language: it</p>",
