abstract="Adequate environmental protection has not always been provided through pipeline safety regulation efforts. Although the issue of laying and operating pipelines in the Arctic National Wildlife Refuge (ANWR) and other environmentally-sensitive areas is not completely solved by the new Pipeline Safety Improvement Act of 2002 (PSIA-2002) and 2006 Pipeline Safety Improvement Act amendments (PSIA-2006), the statutes guide safety regulations so that the National Environmental Policy Act (NEPA) is undergirded. The author argues that oil companies should submit to interagency regulation and oversight in order to expanded PSIA-2002/2006 progress if they hope to drill in ANWR. If successful, the new pipeline safety management era this process represents could be a development model for environmentally sensitive areas whose exploitation or disposal may be considered in the national interest.
