Many states have bullying statutes, some of which specifically include prohibitions on cyberbullying, but most of these statutes do not include a private right of action—meaning victims need some other statutory or common law remedy in order to hold wrongdoers liable and possibly recover for their damages.1 Theories of recovery include defamation, intentional infliction of emotional distress, and invasion of privacy, in addition to negligence claims against a municipal board of education, when viable and appropriate. This Article provides a summary of the statutory schemes in Connecticut, New York, and Massachusetts and an overview of traditional tort remedies.
