A1 - Skopp, Gisela SP - 113 EP - 124 VL - IS - 3 N2 - In case of an offence against § 24a (2) stvG of a motor vehicle driver having been proven via detection of benzoylecgonine and/or cocaine in blood the offender could question predictability by stating that such a long time has been passed since last cocaine use that a hypothetic continuing effect could no longer be expected. An evaluation of published studies on the pharmacokinetics of cocaine and benzoylecgonine in man showed, that cocaine is present in fluoride stabilized blood serum/plasma in excess of 10 ng/ml only in case of a recent ingestion, within the past 24 hours. Cocaine being no longer detectable and benzoylecgonine being present at a concentration of at least 75 ng/ml indicates drug use that may have occurred a longer time ago but during the past 2 days, at most.
