N2  - A case hearing is reported in which a BAC had to be calculated based on a drinking statement. The main drink was unknown to the expert. Referring to witness' testimonies an alcohol level of at least 6 Vol% had to be assumed. Therefore a minimum BAC of 0.24 o/oo had to be presumed at the time of the incident. During a case hearing break the actual ethanol level of 17 Vol% could be detected. Therefore the minimum BAC had to be corrected to 0.68 o/oo and with it the legal consequences of inability to drive. The case shows the importance of the expert knowledge of the alcohol level of indicated beverages in a criminal procedure. In the light of current developments with regard to increased premixed bottled drinks is becomes increasingly harder not lose track. A continually updated data base via Internet on PDA could be a solution to this problem.<p />
