Because the system only allows for the limited use of force, U.S. special forces counterterrorism units are relied upon to carry out the missions they were created for. Therefore, initially, this paper explores the history and capabilities of U.S. military counterterrorism units; then, the different types of missions that these units may be used for within this new system are defined; next, the benefits of prosecuting terrorists under the LOAC are discussed; finally, a method for implementing this new system is suggested.
