Abstract

In order to prevent the chilling effect where one hides information on the accident to avoid legal responsibility, it is necessary to separate the information between the investigation on the causes of the accident and the investigation of legal responsibility. On the other hand the identification of the causes of the accident is necessary for both sides and sharing information would reduce cost. To find out how to solve this dilemma, a comparison was made between the United States and Japan on the relationship between the accident investigation organization and the system of the establishment of criminal, administrative, and civil responsibilities. It could be concluded that the practice was virtually similar. Yet in Japan because of the lack of due process, a chilling effect might be caused by uncertainty.
