Abstract

According to the relevant legislation in Western Germany the State has obligatory responsibilities regarding compensation in cases of the drunk-in-charge. In terms of the legislation the mere seizure of the driving licence or temporary withdrawal thereof are sufficient grounds to allocate compensation. The author analyses the mentioned criteria and warns that if a sentence was passed, based inter alia on an Alco-test, that the final decision regarding compensation should only be made after the blood alcohol concentration has become known.
