Abstract

The article focuses on the case of a 15 year boy who was charged for the rape of a 14 year old girl and was subjected to the custody of the Department of Juvenile Justice (DJJ) of Virginia in 2007. He was subsequently released from the custody in the year 2009 before his filing of a petition of habeus corpus. The Virginia Supreme Court declared that the Circuit Court erred in determining that it did not have jurisdiction to consider his petition for a writ of habeas corpus.
