Abstract

This article proposes a theoretical paradigm for explanation of various transnational organized crime actors including terrorism, drug trafficking, arms dealing, human trafficking, money laundering, and cyber crime in the 21st century environment. Today's transnational organized crime phenomenon may cast a crucial threat to the fundamental order of nation-state system which has been a basis of international security order since the 1648 Westphalia system. Indeed, the Westphalia system, based on international relations among nation-states and state's monopoly of violence within its sovereign territory, reveals much limitation and therefore various transnational organized crime actors flourish due to such limitation. This situation may be related to the necessity of a new theoretical paradigm which can effectively explain those new phenomenon of security threats. However, these efforts have not been enough made and only limited attempts have been done thus far. This article recognizes the importance of this kind of discussion and attempts to propose a theoretical explanatory paradigm.

이 논문의 목적은 테러리즘과 마약거래, 무기밀매, 인신매매, 돈 세탁과 사이버 범죄 등 21세기적인 환경에서 대두되고 있는여러 다양한 국제조직범죄 행위자의 전통적 국가 안보에 대한 위협을 이해하기 위한 이론적 설명 패러다임을 제시하고자하는 것이다. 오늘날 전개되고 있는 국제조직범죄의 여러 현상들은 1648 년 웨스트팔리아 체제 성립이후 지난 3, 4세기 동안 국제안보질서의 기본 축이 되어온 민족국가 단위에 기초한 기본 질서에 중대한 위협을 주고 있는 지도 모른다. 사실상 국가 행위자 간의 협력과 충돌이라는 국제질서의 기본가정과 국가단위 행위자의폭력 독점과 이에 기초한 주권 또는 사법관할 영역 내에서의 형사 사법적 강제력의 독점적 투사라는 기본가정은 오늘날 많은 한계점들을 노출하고 있으며 이에 따라 많은 그리고 다양한 국제조직범죄의 현상들은 통제되지 않은 채로 번성하고 있는 듯이 보인다. 이러한 상황은 오늘날 전개되는 안보질서의 위협들을 보다 새로운 시각으로 설명할 수 있는 이론적 패러다임의 필요를 제기할지 모른다. 하지만 이러한 시도들은 아직 충분할 정도로 시도되지 않았고 단지 제한적으로 제기되고 있을 뿐이다. 이 논문은 이와 같은 논의의 중요성을 인식하여 초보적인 수준에서나마 이론적인 설명 패러다임을 제시해보고자 한다.
