Abstract

Robert Ainis was sentenced by the New Jersey Superior Court to 11 years in prison for robbing a convenience store and brandishing a hypodermic needle while threatening to inject the clerk with AIDS. The New Jersey Superior Court ruled that using the needle in that manner, combined with the threat to deliberately infect a person, constituted a "violent crime." The "violent crime" charge mandates that Ainis serve 85 percent of the sentence. Arguments from both sides are presented. Courts in New York and California have recently issued similar rulings.
