Abstract

This paper is designed to assist healthcare professionals by explaining legal remedies for domestic violence, the processes and consequences for clients pursuing such remedies, and possible ramifications for the professional arising from their involvement with victims or perpetrators, including confidentiality, subpoenas, and giving evidence. The content refers to the Australian legal system and is deliberately broad and practical in focus. The topics covered include: 1. Legal Remedies (criminal charges, apprehended violence orders, sole occupancy orders, and victims compensation) 2. Relevance of domestic violence to other family law proceedings 3. Consequences for counsellors and healthcare professionals (confidentiality and professional privilege, subpoenas, mandatory reporting, and giving evidence).
