Abstract

This paper explores the 'risk-burdening' that accompanies 'precarious employment' in modern business organisation. It is an empirical case study, based on extensive witness testimony to a fatal accident inquiry into a fatality in the offshore oil drilling industry. This serves to highlight the impacts of business organisation on the working environment issues via the agency of 'risk transfer mechanisms'. It seeks to identify outstanding issues of legal accountability and regulatory practice regarding employee safety that remain to be resolved in the context of the blurring of responsibility by modern forms of business organisation.
