Abstract

In France, the practice of the penal psychiatric examinations evolved since the promulgation of the law of June 17th, 1998. Initially dedicated to the determination of the penal responsibility, the requests turned to the prediction of the risk of recurrence. To do it, the free clinical evaluation was the first implemented method. However, the limits of this method imposed an evolution of the practices at the international level, including in Europe. France is thus one of the last countries to pursue the evaluation of the risk of recurrence according to a methodology not validated on the scientific plan. In front of recent mediatized affairs, the question of the relevance of such evaluations deserves to be put.
