Abstract

Social workers may be monetarily liable for negligent performance of placement and supervision of children in foster care. In states where the state retains sovereign immunity those professional activities may be considered ministerial rather than discretionary functions and so not entitled to the immunity from suit which the state enjoys. Careful attention to designated procedures may protect the worker from allegations of negligence.
