Abstract

The problem of public and industry safety caused by defect products became serious with the development of technology and economy in recent years in China. Strict liability that focuses on the identification of product defects has been established. But there are still many problems such as backward standards, lack of quantification assessment and insufficient attention on the design defects which exist in the product liability system. The principle of product defects identification should change from mainly based on national and industry standards to rely on risk-benefit analysis to determine what unreasonable risk is. Performance-based standards should be introduced to solve the problem that standard could not catch up with the development of technology. Product safety assessment system should be established to boost quantity evaluation of product safety
