Abstract

The crime of human trafficking is a transnational criminal business that attacks the dignity and freedom of individuals who have the right to be treated as human beings, never as a mere object. Trafficking in human beings is the realization of cruel practices such as abuse and deception of vulnerable people; the use of violence, threats, coercion and debt bondage ending with both labor and sexual exploitation and the extraction of their body organs. Both for the commisive media and for the intented purpose, the crime of human trafficking is an "intentional crime of early consummation", as it is consumed once typical action is performed; regardless whether labor or sexual exploitation, or the extraction of organs has occurred.

El "delito de trata de seres humanos" constituye un negocio criminal transnacional que ataca la dignidad y la libertad de las personas,que tienen derecho a ser tratadas como seres humanos, nunca como un simple objeto. La trata de seres humanos supone la realización de prácticas crueles como el abuso y el engaño de personas vulnerable; el uso de la violencia, amenazas y coacciones; servidumbres por deudas, con el fin de la explotación laboral y sexual de las personas y la extracción de sus órganos corporales. Tanto por los medios comisivos como por las finalidades perseguidas, el delito de trata de seres humanos, es un"delito doloso de consumación anticipada", ya que se consuma una vez realizada la acción típica, independientemente de que se haya producido o no la situación concreta y efectiva de explotación laboral, sexual o de extracción de órganos corporales.
