Abstract

Government regulations (regulatory administration) hold the key to the success or failure of ensuring the safety of science and technology, but they are difficult for engineers to understand. There are two types of accident law: a regulation law to prevent accidents from occurring and a law to compensate for damages after an accident has occurred. The law of damages was developed early, but the regulatory law was late. Regulation laws were enacted, but the jurisprudence to interpret and put them into practice was blank. The reasons for the continuous blank are that jurisprudence is divided into specialties, and that jurisprudence relies much of its research resources on judicial precedents. In recent years, instead of judicial precedents, research based on social observations has made progress in fundamental elucidation. As an extension of this, this paper clarifies the framework of regulatory administration for ensuring safety. The issues to be tackled from the viewpoint of rational regulatory administration are diverse and almost limitless.[via Google Translate]

政府による規制(規制行政)は,科学技術の安全確保の成否のカギをにぎるが,エンジニアにはわかりにくい.事故の法には,事故が起きないようにする規制の法と,事故が起きてからの損害賠償の法とがある.損害賠償の法は早くから発展したが,規制法は後れた.規制法は制定されるが,それを解釈し実施に移すところの法学が,空白だった.空白が続いた原因は,法学が専門別に分化していること,法学が研究資源の多くを裁判の判例に依存すること,などがある.近年ようやく,判例に代わり,社会観察にもとづく研究によって,根本的な解明が進んでいる.本稿は,その延長上で,安全確保の規制行政の枠組みを明らかにする.合理的な規制行政の観点から取り組むべき課題は,多様であり,無限といってよいほどの広がりがあり,その一つに,法教育のあり方がある.
