Abstract

With the introduction of a draft bill into the Bundesrat, the state government of Saxony strives for the punishment of drink driving without considering the limit values (the 0 per mille regulation) of people under the age of 25. With the introduction of another draft bill into the Bundesrat the Federal government strives to introduce a standardized blood alcohol limit value of 0.5 per mille. This should replace the current 0.8 per mille limit value and legal consequences be introduced from 0.5 per mille. Both draft bills need approving. The latter, on condition that a 0.4 per mille limit value be introduced and the determining of the blood alcohol measurements (with an error margin of 0.1 per mille to be included in the total of 0.5 per mille) be left to the discretion of the fine payment offices and courts. The Federal government draft bill plans to introduce a standardized 0.25 per mille breath alcohol limit value (equivalent to the 0.5 per mille blood alcohol level) which does not incorporate an error margin. Contrary to the views of the BayObLG (the Bavarian provincial high court) the error margin was not included in the breath alcohol limit values introduced in 1998. The evaluation of breath alcohol measurements which are currently measured with the only approved measuring device Drager Alcotest 7110 Evidential MK III could have a considerably reduced error margin if the device was adjusted to the forensic requirements.
