The SafetyLit Web Site (the "Site") is an online information service provided by the SafetyLit Foundation, Inc. in cooperation with the Graduate School of Public Health at San Diego State University, and the Center for the Study and Prevention of Violence at the University of Colorado Boulder. The SafetyLit Foundation also provides information access through several other internet domains. These include: SafetyLit.co, SafetyLit.com, SafetyLit.foundation, SafetyLit.info, SafetyLit.net, SafetyLit.us, ipthesaurus.com, injurypreventionthesaurus.org, safetythesaurus.com, and safetylitthesaurus.com. These terms of service apply to each and all of those domains.Use of SafetyLit is subject to your compliance with the terms and conditions set forth below. Please read this document carefully before accessing or using the site. Accessing or using the Site, constitutes your unconditional agreement to be bound by the terms of this Agreement. If you do not wish to be bound by these terms and conditions, you must immediately cease using this Site. SafetyLit.org may modify this agreement at any time, and such modifications shall be effective immediately upon posting of the modified agreement on the site. You agree to review the agreement periodically to be aware of such modifications and your continued access or use of the site shall be deemed your conclusive acceptance of the modified agreement.
The staff and sponsors of the SafetyLit Foundation make no representations or warrants as to the suitability of this information for your particular purpose, and that to the extent you use or implement this information in your own setting you do so at your own risk. The information provided herewith is solely for your own use and cannot be sold. In no event will SafetyLit Foundation staff or sponsors, the San Diego State University Research Foundation, San Diego State University, the California State University System, Center for the Study and Prevention of Violence at the University of Colorado Boulder or the World Health Organization be liable for any damages whatsoever, whether direct, consequential, incidental, special or on claim for attorney fees arising out of the use of or inability to use the information provided herewith.
SafetyLit includes summaries of "scholarly" reports and journal articles about injury occurrence and risk factors. Articles are considered relevant if they concern any of the pre-event or event elements of the Haddon Matrix; the epidemiology of injury; or the financial, personal, or societal costs or consequences of the any injury or risk factor. In general, articles concerning treatment for injuries or complications of medical care are excluded except when the article also contains information on one of the inclusion criteria. SafetyLit also includes reports on other topics that may help a reader to make decisions about research or prevention strategies and priorities.

IMPORTANT: The Reports summarized in each SafetyLit Update are NOT screened for quality. Indeed, information is provided about findings from "good" and "poor" research. The purpose of SafetyLit is to provide Site users with information to allow users to identify and find material that has been published about injury prevention and safety promotion topics. Even when SafetyLit staff believe that there are methodological errors that affect the research findings or when we disagree with the authors' conclusions and statements of implications, an attempt is made to provide an objective summary of the authors' intent. Material in the 'comments' or 'conclusions' section of each report's summary is provided by the author(s) of the report -- not by SafetyLit. An important part of professionalism is to identify flawed publications and counter the flaws by commenting upon them in a letter to the editor of the journal where the article was published. Further, the best knowledge today may become outdated tomorrow. Older articles with inaccuracies are not removed from the site. These out-of-date items may be useful for authors or researchers who are examining the progression of scientific or social thought on a topic.

Potentially Offensive Material

The SafetyLit Site may contain health- or medical-related materials that are sexually explicit; discussions of violent acts; or social commentary concerning extreme viewpoints. If you find these materials offensive, you may not want to use our Site.

Copyright, Licenses and Idea Submissions

The Site is subject to protection under copyrights, trademarks and/or other intellectual property rights owned, controlled or licensed by SafetyLit and its affiliates or by third parties. These rights are protected by common law, state laws, and U.S. and international laws. SafetyLit expressly reserves all rights, titles, and interests in and to all copyrights, trade names, logos, patents and other intellectual property and proprietary rights in and to the Site, including but not limited to any images, photographs, animations, video, audio, music, text, and "applets"; the overall "look and feel", processes, software, technology, and other materials which appear on this Site; and the business processes used to market products and services. You agree that your rights are limited to those granted herein, and you will not acquire any rights except as expressly set forth in this Agreement.
YOU MAY NOT MODIFY, COPY, REPRODUCE, REPUBLISH, UPLOAD, POST, TRANSMIT, OR DISTRIBUTE, IN ANY MANNER, THE MATERIAL ON THE SITE, INCLUDING TEXT, GRAPHICS, CODE AND/OR SOFTWARE. You may print and download portions of material from the different areas of the Site solely for your own non-commercial use provided that you agree not to change or delete any copyright or proprietary notices from the materials. Excessive downloading of records from the SafetyLit database is prohibited. Expect that your computer IP will be blocked if the SafetyLit system recognizes abuse.

If you believe any materials accessible on or from the Site infringe your copyright, you may request removal of those materials (or access thereto) from this web site by contacting SafetyLit (see information below) and providing the following information:

  1. Identification of the copyrighted work that you believe to be infringed. Please describe the work, and where possible include a copy or the location (e.g., URL) of an authorized version of the work.
  2. Identification of the material that you believe to be infringing and its location. Please describe the material, and provide us with its URL or any other pertinent information that will allow us to locate the material.
  3. Your name, address, telephone number and (if available) e-mail address.
  4. A statement that you have a good faith belief that the complained of use of the materials is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information that you have supplied is accurate, and indicating that "under penalty of perjury," you are the copyright owner or are authorized to act on the copyright owner's behalf.
  6. A signature or the electronic equivalent from the copyright holder or authorized representative.
In an effort to protect the rights of copyright owners, SafetyLit maintains a policy for the termination, in appropriate circumstances, of subscribers and account holders of the Site who are repeat infringers.
SafetyLit sometimes provides opportunities for Site users to comment upon the Site and Site contents, give feedback, make suggestions. Site users may be provided with the opportunity to supply their names to accompany their comments.

You agree to grant to the SafetyLit Foundation, Inc. a non-exclusive, royalty-free, worldwide, perpetual license, with the right to sub-license, to reproduce, distribute, transmit, create derivative works of, publicly display and publicly perform any materials and other information (including, without limitation, ideas contained therein for new or improved products and services) you submit to any public areas of the Site (such as bulletin boards, forums and newsgroups) or by e-mail to the SafetyLit Foundation, Inc. by all means and in any media now known or hereafter developed. You may choose to grant to the SafetyLit Foundation, Inc. the right to use your name in connection with the submitted materials and other information. If you supply your name or affiliation or if you request that your name be credited for your submission, SafetyLit may use your name on the SafetyLit website as well as in connection with all advertising, marketing and promotional material related thereto. You agree that you shall have no recourse against the SafetyLit Foundation, Inc. for any alleged or actual infringement or misappropriation of any proprietary right in your communications to the SafetyLit Foundation, Inc. However, upon request, we will remove any personal or organization names from the Site. Although we will attempt to remove identifying information quickly, there may be technical or practical circumstances that can delay the removal of information.
The SafetyLit Site Content is protected by copyright under both United States and foreign laws. Title to the Content remains with SafetyLit or with the publishers, agencies, and organizations ("providers") that have granted to SafetyLit the limited use of their own copyright material. Under no circumstances will SafetyLit provide copies of any material protected by copyright belonging to any of the outside information providers. Any use of the Content not expressly permitted by these Terms and Conditions is a breach of these Terms and Conditions and may violate copyright, trademark, and other laws. Content and features are subject to change or termination without notice in the editorial discretion of SafetyLit. All rights not expressly granted herein are reserved to SafetyLit and its licensors.

Trademarks

SafetyLit, the SafetyLit logo, the SafetyLit.org domain name, and the phrase "Preventing Injuries By Providing Information" are registered servicemarks owned by David Lawrence. Publications, products, content or services referenced herein or on the Site are the exclusive trademarks or servicemarks of the SafetyLit Foundation, Inc. or David Lawrence. Other product and company names (journal titles, journal cover images, publishing company names, etc.) mentioned in the Site may be the trademarks of their respective owners.

Use of the SafetyLit Site

You understand that, except for information, products or services clearly identified as being supplied by SafetyLit.org, the SafetyLit Foundation, Inc. does not operate, control or endorse any information, products or services on the Internet in any way. Except for the SafetyLit Foundation, Inc.-identified information, products or services, all information, products and services offered through the Site or on the Internet generally are offered by third parties, that are not affiliated with the SafetyLit Foundation, Inc. You also understand that the SafetyLit Foundation cannot and does not guarantee or warrant that files available for downloading through the Site will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the Site for the reconstruction of any lost data.
You assume total responsibility and risk for the use of this Site and the Internet. The SafetyLit Foundation, Inc. provides the site and related information "as is" and does not make any express or implied warranties, representations or endorsements whatsoever (including without limitation warranties of title or non-infringement, or the implied warranties of merchantability or fitness for a particular purpose) with regard to the service, any merchandise information or service provided through the service or on the internet generally, and the SafetyLit Foundation, Inc. shall not be liable for any cost or damage arising either directly or indirectly from any such transaction. The SafetyLit Foundation, Inc. does not warrant that the service will be uninterrupted or error-free or that defects in the service will be corrected.

Site Security

You are prohibited from violating or attempting to violate the security of the Site, including, without limitation, (a) accessing data not intended for your use or logging onto a server or an account which you are not authorized to access; (b) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization; (c) attempting to interfere with service to any user, host or network, including without limitation, via means of submitting a virus to the Site, overloading, "flooding," "spamming," "mail-bombing" or "crashing;" (d) sending unsolicited email, including promotions and/or advertising of products or services; or (e) excessive downloading of records from the literature database. Violations of system or network security may result in civil or criminal liability.
The Site may contain robot exclusion headers that regulate what is available to web spiders. Much of the information on the Site is updated on a regular basis and is proprietary or is licensed to SafetyLit by our suppliers and other third parties. You agree not to use any device, technique, software, system or routine to interfere or attempt to interfere with, or to otherwise circumvent the proper working of this Site or any activity being conducted on this Site. You agree, further, not to use or attempt to use any engine, device, technique, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, scrapers, avatars or intelligent agents) to navigate, access or search this Site, other than generally available third party web browsers such as Google Chrome(tm), Microsoft Internet Explorer(tm), Netscape Navigator(tm), Mozilla Firefox(tm) and Safari(tm). Additionally, you agree that you will not take any action that imposes or may impose (in the sole discretion of us or our suppliers affected by your action) an unreasonable or disproportionately large load on our infrastructure, or the bandwidth or infrastructure of the company that hosts this Site, or bypass the robot exclusion headers or other measures on this Site or on the host servers that may be used to prevent or restrict access.
If you violate any of the terms or conditions of this Agreement, this Agreement terminates immediately without notice. We may deny access to the Site to you and anyone claiming by or through you without liability to anyone. We shall have all additional rights and remedies at law and in equity arising from such violation. Further, you agree to indemnify, defend and hold SafetyLit, and its affiliates, sponsors, suppliers, employees and agents harmless from all claims, actions, losses, liabilities, damages, costs and expenses (including attorneys fees) arising out of or relating to any such prohibited use of the Site.

LIMITATION OF LIABILITY

In no event will the SafetyLit Foundation, Inc. be liable for

(i) any incidental, consequential, or indirect damages (including, but not limited to, damages for loss of profits, business interruption, loss of programs or information, and the like) arising out of the use of or inability to use the service, or any information, or transactions provided on the service, or downloaded from the service, or any delay of such information or service even if SafetyLit.org or its authorized representatives have been advised of the possibility of such damages, or

(ii) any claim attributable to errors, omissions, or other inaccuracies in the service and/or materials or information downloaded through the service.

Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, the use of SafetyLit by residents of those states is considered a violation of the terms of use set forth in this Agreement. If you are a resident of a jurisdiction that does not allow the exclusions and limitations of liability set forth above, you must immediately stop using this Site.

Statement Concerning Links To External Websites

The SafetyLit Foundation makes no representations whatsoever about any other web site which you may access through this one or which may link to this Site. Although we have made a good faith effort to link only to tasteful, appropriate sites, the owner of any Internet domain name may change and the nature of content on any website may also change. When you access a non-SafetyLit.org web site, please understand that it is independent from the SafetyLit Foundation, Inc., and that the SafetyLit Foundation, Inc. has no control over the content on that web site. In addition, a link to an outside web site does not mean that the SafetyLit Foundation, Inc. endorses or accepts any responsibility for the content, or the use, of such web site.
You understand further that the Internet contains unedited materials some of which are sexually explicit or may be offensive to you. Your access to such materials is at your own risk. The SafetyLit Foundation, Inc. has no control over and accepts no responsibility whatsoever for such materials.
SafetyLit believes that those who make information available on the Internet expect that it will be publicly and widely available. Therefore, we believe that linking to other sites is legally permissible and consistent with the expectations of those who provide a website as well as that of those who use the Internet. However, if access to a particular site should be restricted, the site operator should promptly notify us using the information supplied below. The link to that site will be removed.

Term and Termination of Agreement

This Agreement may be terminated by either party without notice at any time for any reason. The provisions of the following paragraphs (Copyright, Licenses and Idea Submissions, Use of the Service, Indemnification, Third Party Rights, Miscellaneous) shall survive any termination of this Agreement.

Miscellaneous

This Agreement shall all be governed and construed in accordance with the laws of The United States of America applicable to agreements made and to be performed in The United States of America. You agree that any legal action or proceeding between the SafetyLit Foundation, Inc. and you for any purpose concerning this Agreement or the parties' obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in The United States of America. Any cause of action or claim you may have with respect to the Service must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. The SafetyLit Foundation's failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. The SafetyLit Foundation may assign its rights and duties under this Agreement to any party at any time without notice to you.
Any rights not expressly granted herein are reserved.
Any delay or failure to act with respect to a breach of this Agreement by you or others does not constitute a waiver and shall not limit such rights with respect to such breach or any subsequent breaches. This Agreement shall be governed by and construed in accordance with the laws of the State in which the SafetyLit Foundation resides. If any provision of this Agreement is held to be invalid or unenforceable, such invalidity or unenforceability shall not affect the remainder of this Agreement, which shall be given full effect without regard to the invalid portions.
