Abstract

The author gives a critical account of the reasoning upon which Beine/Lange base their argument in favour of an alteration of the legal provisions regarding the process of revoking and reissuing drivers' permits. He rules out the technique of comparing court judgments in cases acc. to sect. 69 par. 2 Penal Code with those decisions by the administration in cases to be handled under the provisions of sect. 15 c par. 3 Traffic Code, because the legal situation - as clearly defined by the law - is entirely different in either field, thus not comparable. According to the author, the conclusion drawn by Beine/Lange is to be considered false. The administration's superior efficiency in comparison to court judgments should lead to the restitution of the administration's sole competence to revoke driver's permits.
