Abstract

The purpose of this study is to review the Reserve forces's outline, progress and related to the offender's types and characteristics of depressive disorder, look at the Reserve forces's the organization and formation process and the Reserve forces's armed and shooting warrant also unsuitable Reserve forces's proceeding prescript, discuss problems of Reserve forces's training and indicate improvement scheme of that issues. The Reserve forces's Firearms Accident was caused by a reserve forces solder shooting the other 4 soldiers and 2 people died, The offender is using a firearm incidents committed suicide at the scene. According to investigation results released in case, The offender was running premeditated murder, had a past psychiatric history and treatment and was confirmed that the recent stressful life events. Depressive disorders with the offender are classified according to a variety of symptoms, depressive disorder and disruptive mood dysregulation disorder is a high risk of suicide. Reserve forces's the organization is an organization aimed at person discharged from military service and organized into a residence and work, Reserve forces may be necessary for an armed mission, the weapons may be used and It becomes a personal firearm shooting from the reserve training courses. Unsuitable reserve forces are treated by change of Assignment to Military Service of the procedure. Reportedly reviewing the institutional limits of the Reserve Training Management, personal information related to the mental health of the Reserve forces can not be processed according to the legal control, In reservist laws the reason for the restriction to fire regulations are ambiguous and The management system by proactive measures to reserve resources is insufficient. Therefore, to improve the institutional direction to prevent firearm accidents reservists, It need to create a basis to handle sensitive information related to health in the reserve related laws, It must be clearly redefined the rules for reservists carry weapons prohibited grounds, Simple psychological testing should be conducted prior to training reservists.

Vernacular Abstract

본 연구는 예비군 총기사건의 개요, 경과 그리고 가해자와 관련된 우울장애의 유형과 특징을 검토하고, 예비군의 조직과 편성절차와 예비군 무장 및 개인화기 사격의 근거 그리고 부적격자 처리 규정을 통해 예비군 훈련제도를 규범적으로 고찰하여 이와 관련된 예비군 훈련 관리의 제도적 한계를 살펴본 후, 예비군 훈련 및 관리 차원에서 사고예방을 위한 제도적 개선방안을 제시하였다. 예비군 총기사건은 사격 훈련을 받던 예비군이 훈련준비를 하던 다른 예비군 4명을 조준하여 사격함으로서 3명이 사망한 사건으로서, 가해자는 현장에서 총기를 사용하여 자살한 사건이다. 본 사건의 수사결과 발표에 의하면 가해자는 계획적인 범행을 실행하였고, 과거 정신과 진료를 받았던 기록과 최근 생활상 스트레스가 있었던 점이 확인되었다. 총기사건의 가해자와 관련된 우울장애는 증상의 정도와 지속기간에 따라 다양하게 구분되고 주요우울장애와 파괴적 기분조절곤란 장애는 자살의 위험성이 높다. 예비군 조직은 향토예비군 설치법을 근거로 법률상 해당하는 전역자를 대상으로 조직되어 거주지나 직장 단위로 편성되고, 예비군은 임무수행을 위하여 필요한 무장을 할 수 있고 요건에 따라 무기를 사용할 수 있으며 예비군 교육훈련 과정에서 개인화기 사격을 하게 된다. 또한 예비군 훈련의 부적격자는 병역처분변경원서 신청을 통해 신체검사 결과에 따라 병역변경 처분이 가능하다. 예비군 훈련 관리의 제도적 한계를 검토한 바에 의하면, 예비군자원의 정신적 건강과 관련된 개인정보는 적법한 통제에 따라 연동되어 처리가 불가하고, 예비군 관련 법규에서 정신장애 등과 관련된 사격 제한의 사유가 모호하게 규정되어 있으며, 군 복무 과정에서 정신장애의 소견에 의하여 부적응적 생활을 한 예비군자원에 대한 사전적 조치에 의한 실질적 관리체계가 미흡한 실정이다. 따라서 예비군 총기사고를 예방하기 위한 제도적 개선방향으로 향토예비군 관련 법령에서 건강과 관련된 민감정보를 처리할 수 있는 근거를 별도로 마련하여야 하고, 예비군 무기휴대금지 사유에 대한 규정을 명확히 재정립하여야 하며, 예비군 훈련 전 단계인 인도인접 간 간이심리검사를 시행하는 방안을 제시하였다.
